Listing Agreement Requirements: Can I List a Property Without One?

No. A fully signed listing agreement must be in place before or at the time a property is submitted to MLS Now. You cannot enter a listing without one.

What the listing agreement must include:

  • Express authorization for the broker to submit the listing to MLS Now
  • A list date and a definite, final termination date
  • The full gross list price (unless it is an auction listing)
  • Authorization for the broker to provide the agreement and any amendments to MLS Now upon request

(Rule 2.1.1)

Submission deadline (Rule 2.2.1):

A listing must be filed by the EARLIER of:

  • Two business days after a fully signed exclusive listing agreement, OR
  • One business day after the property is marketed to the public (yard signs, digital marketing, public-facing websites, multi-brokerage networks, etc.)

If the listing is not yet being shown at all, it must be entered with the "Temporarily Off Market" status. If the seller wants the listing in PREP status, the Seller PREP Authorization form and the listing agreement must be submitted to the MLS within two business days of the list date (Rule 2.2.3).

If MLS Now requests a copy of the listing agreement, the Participant must provide it within one business day (Rule 2.1.2).

Note: Net listings, open listings, wholesale, and one party listings are NOT accepted by MLS Now (Rule 2.4.4).

See MLS Now Rules: Section 2 – Listing Entry Requirements for the full rule text.
